Understanding the ‘right to disconnect’ under the Fair Work Act 2009 (Cth)


The rights of refusal are workplace rights for the purpose of Part 3-1 of the Fair Work Act, meaning that the employer is prevented from taking adverse action against an employee who exercises or proposes to exercise this right.


How will this apply to the Agricultural Industry where we traditionally have workers living 'on-farm', in provided accomodation and needing to work in accordance with climate and farming cycles?

This new legislation passed through parliament and received royal assent on the 26th of February 2024, meaning that the provisions will commence in August. There is a window here to consider how the introduction of this new right will impact Agribusiness operations and processes.
